In April of this year, a California Court of Appeal provided guidance for healthcare employers who had or continue to have vaccination mandates. In Hodges v. Cedars-Sinai Medical Center, the Court of Appeal ruled that a hospital’s decision to terminate an employee for failing to comply with its flu vaccination mandate did not violate California’s Fair Employment and Housing Act prohibition on disability discrimination.

California Publishes Monkeypox Guidance for Employers

On Thursday, September 15, 2022, California’s Division of Occupational Safety and Health (“Cal/OSHA") issued guidance on protecting employees from monkeypox (the “Guidance”). The Guidance applies to workplaces covered by the Aerosol Transmissible Disease standard (the “ATD”) (Title 8 Code of Regulations Section 5199), including health care facilities, medical transport, police services, public health services, laboratories, and more.

Cal/OSHA Issues Draft Semi-Permanent COVID-19 Rules

As employers know, Cal/OSHA enacted COVID-19 Emergency Temporary Standards (“ETS”). Just recently, Cal/OSHA has published draft semi-permanent standards that, if enacted, would supersede the current ETS for a period of two or three years.
