In April of this year, a California Court of Appeal provided guidance for healthcare employers who had or continue to have vaccination mandates. In Hodges v. Cedars-Sinai Medical Center, the Court of Appeal ruled that a hospital’s decision to terminate an employee for failing to comply with its flu vaccination mandate did not violate California’s Fair Employment and Housing Act prohibition on disability discrimination.

The Biden Administration has announced that it will be ending most federally mandated COVID-19 vaccination mandates on Thursday, May 11, 2023. Included in the Administration’s vaccine-mandate rollback is the Administration’s much-maligned mandate for federal contractors, which has been subject to challenges in federal court.

COVID-19 is a zombie that just won’t die. On August 11, 2022, the CDC published new COVID-19 guidelines. In many ways, the CDC’s new guidelines drastically depart from its prior guidelines. But, in other ways, the new guidelines re-affirm the CDC’s long-entrenched guidelines.
