Cal/OSHA is at it again. A few days ago, Cal/OSHA published proposed revisions to its COVID-19 Emergency Temporary Standards (ETS) rules. (The proposals are available here.) Cal/OSHA will formally vote on whether to adopt the proposed rules on April 21, 2022. If, as expected, these new rules are adopted, employers should know about some of the key anticipated changes.

COVID-19 laws are changing rapidly and unpredictably. This past Friday, December 17, 2021, a federal court in Ohio surprisingly reversed a nationwide injunction against federal OSHA’s COVID-19 vaccinate-or-testing mandate for large employers (i.e., employers with 100 or more employees). Thus, effective last Friday, the federal OSHA rules (the “Rules”) are back in effect.

Earlier this month, employers heard that federal OSHA is planning to roll out a national vaccine-or-testing mandate for large employers (i.e., employers with a workforce of at least 100 employees). While details of that mandate have not been made public yet, employers would do well to plan ahead.
