Starting January 1, 2025, the salary threshold for overtime exemptions under the Fair Labor Standards Act (“FLSA”) will increase again. Employers must ensure compliance with these changes. The FLSA mandates that covered employers pay overtime at time-and-a-half for hours worked over 40 in a week, but certain employees—specifically bona fide executive, administrative, or professional employees—are exempt from minimum wage and overtime provisions under the "white-collar" exemption. Additionally, there is a separate exemption for highly-compensated employees (“HCE”).

On April 23, 2024, the United States Department of Labor (“DOL”) released a final rule on overtime exemption. This final rule will increase the minimum salary amount required to be paid to executive, administrative and professional (“EAP”) employees to be considered exempt from the Fair Labor Standards Act (“FLSA”) overtime pay requirements.

Last month, US Senator Sherrod Brown introduced the Restoring Overtime Pay Act of 2023 (“ROP Act”) in Congress, a bill that seeks to increase the exempt salary threshold, thereby providing overtime protections to many more employees who are currently classified as exempt under the Fair Labor Standards Act (“FLSA”). If passed, the bill would update the FLSA, which was first enacted in 1938 and has not been significantly amended with respect to minimum wage and overtime exemptions since 2004.
