The Risk of Inaccurate or Inflated Evaluations

Performance reviews are an important management tool, but when handled poorly they can create significant legal risk for employers. Inconsistent or overly positive evaluations that contradict later disciplinary actions are frequently used by employees to challenge termination decisions or allege discrimination, retaliation, or wrongful termination. For this reason, employers should treat performance reviews not only as a management tool, but also as an opportunity to reduce legal risk.

One common mistake is providing inflated or vague feedback in order to avoid difficult conversations. While this may seem easier in the short term, it can create problems if the employee is later disciplined or terminated for performance-related reasons. If a review consistently describes an employee’s work as satisfactory or above expectations, it becomes more difficult to justify later claims that the employee was underperforming. Performance evaluations should accurately reflect both strengths and areas requiring improvement.

The Importance of Consistent Documentation

Documentation and consistency are equally important. Managers should rely on specific examples of performance, measurable outcomes, and objective criteria whenever possible. Reviews should also align with any prior counseling, written warnings, or performance discussions. When evaluations, disciplinary actions, and internal records tell the same story, employers are in a much stronger position to defend their decisions if they are later questioned.

Training Managers to Conduct Effective Reviews

Employers should ensure that managers are properly trained on how to conduct performance reviews. Reviews should be thoughtful, factual, and free from subjective language that could be misinterpreted. When handled properly, performance evaluations can reinforce accountability, provide clear expectations for employees, and help protect the business if employment decisions are later scrutinized.

Performance reviews serve an important role beyond evaluating employees. Clear feedback and accurate documentation help establish expectations, support management decisions, and create a reliable record if employment actions are later questioned.
